Real Estate Investment Trust, Founders Hit With SEC Fraud Suit

The Securities and Exchange Commission has filed a fraud lawsuit against a Tampa, Florida-based real estate investment trust and its founders, accusing them of orchestrating a $152 million scheme that misled more than 5,500 investors.

According to the SEC's complaint, the executives falsely portrayed the company as profitable while secretly funneling nearly $5 million of investor money into personal expenses. The agency alleges the trust's founders used deceptive accounting and fabricated financial reports to hide the true state of the business. Investors were told the company was generating steady returns, when in reality it was losing money and relying on new investor funds to pay earlier investors.

The SEC claims the scheme ran for several years, during which the founders enriched themselves with luxury items, real estate purchases, and other personal costs. The lawsuit seeks civil penalties, disgorgement of ill-gotten gains, and permanent injunctions against the defendants.

The case highlights ongoing regulatory scrutiny of private real estate investments, where smaller investors often lack access to detailed financial audits. The SEC urged anyone who invested in the trust to review their statements and report suspicious activity to the agency.
